The U.S. Constitution was ratified in 1788 and that was the beginning of the political system in America that is still active nowadays. More and more there are debates on how democratic the constitution is, and that it is not surprising since Americans still look back at a document that was created 226 years ago. Americans are fighting the constitution regarding all kinds of problems and they are fighting laws that are based on the constitution and the constitutionality of a law. The U.S. Constitution is open for interpretations which makes it a problem in American society because people can interpret it the way it fits them best and makes people become divided on certain issues. The Articles of Confederation were written in the Continental Congress in 1776 and 1777, the Articles outline America’s first national government and were finally adopted on March 1, 1781. In the Articles there was no executive, no judiciary, no separation of powers and no checks and balances. A problem with this system was that the states remained almost completely sovereign, obeying the Congress only when they wanted to. The Articles were replaced by the U.S. Constitution on March 4, 1789. The Constitutional Convention met in Philadelphia between May 25 and September 17, 1787, and produced the U.S. Constitution. There were a couple of unsolved problems the delegates had to deal with to the puzzle of democratic constitutionalism – limited government, separation of powers, checks and balances, bicameralism, and federalism – but they were not sure on how to produce justice, strength, and stability over time. In the Constitutional Convention the delegates wanted to adjust the balance of power between the national and state governments, and so they came up with federalism, a form of government that divides the powers of government between national and subnational levels. Separation of powers is the idea that distinctive types of governmental power, most obviously the legislative and executive powers, and later the judicial power, should be placed in separate hands. The most important achievement of the U.S. Constitution is that it gave power to the people. The U.S. Constitution was written in an undemocratic age. The Founders did not intend to write a democratic constitution. They did not intend to treat minorities and women as equals because before the ratification of the constitution women, blacks and native Americans could vote because there was a selective sense of continuity. They intended to write a constitution that would check, balance and limit political power while protecting the individual and property rights of white men. So a lot of critics nowadays find many of its key structural elements undemocratic and call for their removal or revision. In the American Political system money is a great factor on who is going to be elected, also the price of admission is a certain amount of money.
