The plaintiff’s best argument that Dean is responsible for BSP’s actions is the doctrine of respondeat superior a Latin term meaning, “let the master respond.” Dean’s best defense is that an agent such as BSP is responsible for his or her own torts (Miller, 2013, p.407). A principle such as Dean, conducting an activity, such as hiring BSP to deter thieves and vandals, may be liable for harm resulting from negligence or recklessness in their hiring process. The plaintiff needs to establish that Dean should have been more comprehensive in their interviewing, hiring, and retention practices concerning BSP. The plaintiff needs to prove that Dean should have conducted background checks to confirm which BSP personnel were certified armed guards and that any uncertified personnel were not carrying firearms. Dean needs to establish that Wyden was unaware of the fact that Gaines was uncertified to be an armed guard, and that he chose to carry a gun of his own accord.
