Gun Solution Pro Case Speech Good afternoon! We the Pro team affirm the resolve that the Protection of Lawful Commerce in Arms Act should be repealed in an effort to stop gun violence. The Protection of Lawful Commerce in Arms Act or PLCAA is a law which protects firearms manufacturers and dealers from being held liable when crimes have been committed with their products. We will support this resolve with three main contentions. The PLCAA shields the gun industry from liability for negligence The Act increases recklessness when selling guns The Act’s repeal will decrease gun violence Our first contention states that the PLCAA shields the gun industry from liability for negligence. According to the Atlantic, “The Bush-era legislation protects gun manufacturers and gun dealers from civil liability for crimes committed with their weapons. Since the law passed in 2005 there have been many attempted lawsuits against gun manufacturers and dealers, but few have been successful. One of the many unsuccessful cases is Brady v. Lucky Gunner, after the Aurora Colorado movie theater shooting. According to Huffington Post, “ Lucky Gunner sold 4,000 bullets to a mass murderer in one sale without even checking his driver's license.” However due to the PLCAA, that is not considered negligence. Since the case was dismissed, the judge ruled that the victims’ families would have to pay Lucky Gunner $203,000. The appeal of the PLCAA would ensure that abominations like the ruling in Brady v. Lucky Gunner would no longer happen. As well as someone being able to buy enormous amounts of ammunition with no discretion. “The law really insulated those manufacturers and sellers from a normal negligence standard,” said Josh Horwitz, executive director of the Washington, D.C.-based Coalition to Stop Gun
