1. I had briefly heard of the case involving Liebeck. V. McDonald, I did not hear many facts about the case, other than Ms. Liebeck had bad burns. The way that I thought the burns occurred were from someone spill coffee on her and I did not realize how bad the burns actually were. After watching the document I saw how bad that it actually was. The burns were 3rd degree burns and required skin grafts, which means the coffee was way to hot. I understand that coffee needs to be hot but there is a threshold that it should not pass because it can be almost deadly. Mrs. Liebeck was seventy- nine years old when this happened, something I was not aware of before watching the film. From my understanding tort reform is trying to stop what they believe to be pointless lawsuits that are used just to get money from the business. It is a campaign lead by high-ranking officials in order to stop many civil lawsuits that they believe to be made up in order gets money. My understanding of caps of damages is when the state or federal government sets the amount that can be awarded during any civil case. There are many consequences that will happen as a result of caps on damages through tort reform. it takes away money that people need to either help themselves pay for things or help their family after something bad happens. While it is trying to stop frivolous lawsuits, it hurt the everyday people. A majority of the people are not filing frivolous lawsuits, they are filing because they do not have a choice, they either need the money or the awareness for what happened so it does not happen to anybody else. With the states that have caps on damages it has not caused insurances to go down it has actually gone up, it is not doing any good for the citizens that live in those states. In my opinion that judge should decide how much money to give if a person wins the lawsuit. The judge should decide because he is a neutral party and should not be sway just about the money. If the judge is able to make the decision, he can look at what the family will actually need or what they do not need. Many of the families that file lawsuits and win need the money either for medical care that is currently happening or if they need to be cared for in the future. If these families are not given the money and award much less, taxpayers will be paying for it in the future. The judge should decide caps because that what they are paid for and to award what is right and
