1) According to the NY Penal code, first degree murder can be defined as a planned murder with intention to kill one or more persons. A murder will be classified first degree if the victim was a control worker; such as a police officer, firefighter, paramedic etc. One may also be considered first degree if the murder occurred during the commission of another crime such as robbery, hijacking, kidnapping, furthermore, if the defendant has committed murder in the past. Whereas, second degree murder can be defined as an intentional killing to one or more persons for a personal gain, or as a result of reckless conduct. Manslaughter in the first degree is a class B felony; it can be defined as intent to cause serious bodily harm to a person that leads to the death of that person, or of a third person. It may also be considered first degree if the intent was to kill but the defendant was under the influence of extreme emotional disturbance. In contrast, second degree manslaughter is a class C felony, it occurs when the defendant causes death to a person as a result of reckless conduct, such as committing an abortion act on a pregnant female that leads to her death, or aiding someone in committing suicide. 2)…show more content…
