This chapter differentiates between human trafficking and human smuggling. The most important difference to note is that people who are smuggled are seen as individuals who willingly participated in the crime and are a part of the criminal organization to an extent, whereas individuals who are trafficked are seen as victims of a crime. Human smuggling proves to be beneficial for both the smuggled and the smugglers, so both parties participate in the crime. In fact, human smuggling occurs when the smuggled individual crosses a border illegally and when there is a material benefit for the smuggler.
