1. In my opinion, he did have an obligation to find out if there was a rat problem at the LaGrou warehouse. In the courts decision they even said that Stewart had a responsibility to install systems that would keep the warehouse sanitized, which would have kept the warehouse rat free. In this scenario, I believe it might be harder to prove criminal intent, because you would have to prove the case beyond a reasonable doubt. If a civil case was pursued against Stewart they would only have to prove the case using a preponderance of the evidence. In other words, the jury or judge would not have to be 100% certain that he was guilty. They would only have to believe there was enough proof that more than likely
