Irene, the real estate broker, is to be considered an agent in regards to this case because “The broker owes a professional duty to the owner and acts as the owner’s agent in the sale of the home.” Hopkins v. Fox & Lazo Realtors, 132 N.J. 426, 440, 625 A.2d 1110 (1993). Furthermore, a broker has the same trusts and duties of an agent. “A broker so employed is charged with the trusts and duties of an agent.” Young v. Hughes, 32 N.J. Eq. 372, 373 (1880). With the case law proving that Irene is to be considered an agent, we can now examine her role in the injury of Anthony Ford.
